Chapter 87

Chapter 87: Vehicles Other Than Railway or Tramway Rolling Stock, and Parts and Accessories Thereof

Chapter 87 covers every road vehicle that isn't railway or tramway rolling stock — tractors, buses, passenger cars, goods vehicles, special-purpose vehicles, motorcycles, trailers, and their parts and accessories. It's a short chapter by note count, but two of its four notes exist specifically to stop an importer from routing a product to the wrong heading based on how assembled or how toy-like it looks.

What's in This Chapter

Note 1 excludes railway or tramway rolling stock designed solely for running on rails — the boundary between this chapter and Chapter 86. Note 2 defines "tractors" and adds a rule that's easy to miss: tools and working attachments designed for fitting to a heading-8701 tractor remain classified in their own respective headings even when presented mounted on the tractor at the time of import.

Note 3 is a short but consequential rule: a motor chassis fitted with a cab falls in headings 8702 to 8704 — the finished-vehicle headings — and not in heading 8706, which covers chassis fitted with engines but without bodies. Note 4 draws a boundary that trips up importers regularly: children's bicycles fall in heading 8712 (vehicles), but other children's cycles — tricycles, scooters, pedal cars — fall in heading 9503, the toy chapter.

HeadingDescription
8701Tractors (other than tractors of heading 8709)
8702Motor vehicles for the transport of ten or more persons, including the driver
8703Motor cars and other motor vehicles principally designed for the transport of persons (other than those of heading 8702), including station wagons and racing cars
8704Motor vehicles for the transport of goods
8705Special purpose motor vehicles, other than those principally designed for the transport of persons or goods (for example, wreckers, mobile cranes, fire fighting vehicles, concrete mixers, road sweepers, mobile workshops)
8707Bodies (including cabs), for the motor vehicles of headings 8701 to 8705
8708Parts and accessories of the motor vehicles of headings 8701 to 8705
8711Motorcycles (including mopeds) and cycles fitted with an auxiliary motor, with or without side-cars; side-cars
8713Carriages for disabled persons, whether or not motorized or otherwise mechanically propelled
8716Trailers and semi-trailers; other vehicles, not mechanically propelled; and parts thereof

What's Commonly Misclassified in This Chapter

Note 3's chassis-with-cab rule catches importers who assume an unfinished-looking vehicle belongs in the parts/chassis heading (8706) rather than the finished-vehicle headings (8702–8704). The note says otherwise: as soon as a cab is fitted to the chassis, it's a vehicle of 8702–8704, not a component of one — a heading-assignment rule that pre-empts any GRI 2(a) "incomplete article" reasoning an importer might otherwise reach for.

Note 4's bicycle/toy boundary runs the same trap in the opposite direction: a genuinely rideable children's bicycle is a vehicle (heading 8712, in Chapter 87's sibling heading — not itself listed above but governed by this note), while a tricycle, pedal car, or scooter marketed for children is heading 9503, a toy — even though both are "a wheeled thing a child rides." Getting this backwards affects both the duty rate and which regulatory regime (consumer product safety for toys vs. vehicle standards) applies.

Note 2's tractor-attachment rule is a third recurring issue: a working tool or implement designed to mount on an 8701 tractor doesn't merge into the tractor's classification just because it's presented mounted at time of entry — it keeps its own heading, which importers who classify by "how the shipment looks" rather than by the legal text tend to miss.

How Kanon Classifies Chapter 87 Products

Notes 3 and 4 are drafted as explicit, checkable conditions rather than open-ended standards, so Kanon's GRI traversal applies them as deterministic rules ahead of any GRI 2(a) or essential-character reasoning — a chassis-with-cab is routed to 8702–8704 as soon as that condition tests true, and a wheeled ride-on product is routed by the bicycle/toy distinction Note 4 draws, not by a subjective read of how the product is marketed. Both determinations are recorded in the reasoning trace with the specific note text applied.

Frequently Asked Questions

Does a motor chassis fitted with a cab classify as a vehicle or a vehicle part?

As a vehicle. Chapter 87 Note 3 states that a motor chassis fitted with a cab falls in headings 8702 to 8704 (the finished motor vehicle headings), not in heading 8706, which covers chassis fitted with engines but without a cab or body.

Are children's bicycles classified as vehicles or as toys?

As vehicles. Chapter 87 Note 4 places children's bicycles in heading 8712. Other children's cycles — tricycles, pedal cars, scooters — fall instead in heading 9503, the toy chapter, even though both are ride-on products marketed to children.
