Incomplete Goods — GRI 2(a)
GRI 2(a) provides that any reference in a heading to a particular article includes a reference to that article incomplete or unfinished, provided the incomplete or unfinished article has the essential character of the complete or finished article. GRI 2(a) also extends coverage to complete or finished articles presented unassembled or disassembled. Both limbs of GRI 2(a) are routinely applied in manufacturing and supply chain imports.
In Detail
The first limb of GRI 2(a) — incomplete or unfinished goods — is invoked when a product as imported does not precisely match the complete article described in a heading, but shares its essential character. The “essential character” test under GRI 2(a) is the same concept applied under GRI 3(b): the attribute or attributes that give the article its fundamental identity. A car body without its engine may still have the essential character of a motor vehicle; a bicycle frame without wheels requires a more intensive essential character analysis.
The second limb of GRI 2(a) — complete or finished articles presented unassembled — is particularly important in commercial trade. Goods disassembled for shipping, packaging efficiency, or logistical reasons (flat-pack furniture, CKD automobiles, knocked-down industrial equipment) are classified as if assembled, provided all the components of the complete article are present. This is the legal basis for knocked-down goods classification and is routinely applied across automotive, furniture, and machinery imports.
GRI 2(a) does not require that the incomplete article be capable of performing its ultimate function. A casting that will become a pump component may be classifiable as a pump part under GRI 2(a) if it has the essential character of the finished part. However, raw materials and basic shapes — steel billets, plastic pellets — do not have the essential character of the finished articles they will eventually become and are not classifiable under a finished goods heading via GRI 2(a).
Classification Significance
Incorrect application of GRI 2(a) — either by using it when the incomplete article lacks essential character, or by failing to apply it when it clearly applies — produces classification errors that compound across every element of the entry. The “unassembled” limb is particularly consequential in manufacturing supply chains, where component-level classifications affect both duty rates and trade remedy exposure.
